Summary of Key Commitments
Winkora is designed solely for consensual couples to connect privately. You retain full ownership of your memories and photos. There is strictly zero tolerance for abusive, non-consensual, or objectionable content. Please treat your partner and our platform with mutual respect.
1. Agreement to Terms
These Terms of Service and End User License Agreement ("Terms" or "Agreement") constitute a legally binding agreement between you ("User" or "you") and Winkora ("Company", "we", "us", or "our") governing your access to and use of the Winkora application, website, and related backend services (collectively, the "Service").
By registering for, accessing, or using Winkora, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use and delete your account.
2. Eligibility & Account Security
- Age Requirement: You must be at least 17 years old (or the legal age of digital consent in your jurisdiction) to create an account or use Winkora.
- Account Integrity: You agree to provide true, accurate, and current information during registration (via email or Apple Sign-In).
- Credential Confidentiality: You are responsible for maintaining the confidentiality of your device and login credentials. You accept full responsibility for all activities that occur under your account.
3. Couples Space, Pairing & Uncoupling Mechanics
Winkora operates on a closed-loop, one-to-one couple architecture:
- Each account may only be actively paired into one (1) "Nest" (couple space) at any given time.
- Pairing requires exchanging a time-sensitive, single-use 6-character invitation code. Both parties must mutually review and confirm the connection.
- Either partner holds the autonomous right to unpair the space at any moment directly from the settings screen. Upon uncoupling, real-time data sync terminates immediately, and the shared space is closed.
4. Scope of License (Apple EULA Standard)
Subject to your compliance with these Terms, Winkora grants you a non-transferable, non-exclusive, revocable license to access, install, and execute the software on authorized Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You acknowledge that this Agreement is concluded between you and Winkora only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Winkora application or the content thereof, and Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Winkora.
5. Objectionable Content & Zero Tolerance Policy (App Store Guideline 1.2)
Zero-Tolerance for Harassment and Abuse
Winkora enforces a strict Zero-Tolerance Policy against objectionable, abusive, defamatory, harassing, or sexually explicit content involving non-consenting parties or minors.
You expressly agree not to post, transmit, or share content that:
- Is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, or libelous.
- Depicts non-consensual intimate imagery, sexual assault, harassment, or exploitation of any kind.
- Promotes self-harm, discrimination, racism, hatred, or physical harm of any kind against any individual.
- Infringes upon any patent, trademark, trade secret, copyright, or privacy rights of any person.
Reporting and Blocking Mechanisms (24-Hour Action Commitment)
Although Winkora spaces are private to couples, we provide built-in tools to ensure user safety:
- Instant Unpairing / Blocking: If your partner behaves abusively, you can instantly unpair and block further interaction via Us → Disconnect Space.
- Reporting Objectionable Content: You can report any abusive or policy-violating content directly to our safety review team at safety@winkora.app or via our Help Center form.
- 24-Hour Review & Ejection: In accordance with App Store safety guidelines, Winkora commits to reviewing all reported objectionable content within twenty-four (24) hours. Upon verification, the offending content will be permanently removed, and the abusive user account will be terminated and ejected from the platform.
6. User Generated Content (UGC) & Likeness Rights
You retain all copyright, moral rights, and intellectual property ownership in the photos, text whispers, Daily Duet snapshots, and notes you submit to Winkora ("User Content").
By transmitting User Content, you grant Winkora a limited, non-exclusive, royalty-free, worldwide license solely to store, process, display, and transmit such content between you and your paired partner strictly for delivering the Service. We do not use your private photos or messages for marketing, AI training, or advertising.
Likeness Rights & Disputed Shared Media Upon Separation
In the event of relationship termination, separation, or account deletion, either party has the right to request the complete removal of any shared content containing their own likeness, face, or sensitive personal information. You may submit a takedown request to privacy@winkora.app, and our team will promptly purge the disputed media.
7. Subscriptions, In-App Purchases, & Apple Billing Terms (Guideline 3.1.2)
If you purchase any optional premium tiers, subscriptions, or digital features within Winkora, the following terms govern:
- Payment: Payment will be charged to your Apple ID Account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours prior to the end of the current billing cycle.
- Renewal Charges: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- Managing Subscriptions: You can manage or cancel your subscriptions anytime by going to your iOS device Settings → [Your Name / Apple ID] → Subscriptions after purchase.
- Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
8. Offline Safety, Rendezvous & Non-Emergency Disclaimer
- Not an Emergency Service: Winkora is a social and emotional connection utility, NOT an emergency response tool, personal safety alarm, or medical device. In life-threatening emergencies, always dial your local emergency services (e.g., 911, 112, 999).
- Offline Safety: While Winkora permits sharing point-in-time location pins for meeting your partner, you are solely responsible for your physical safety, transportation choices, and in-person rendezvous. Winkora disclaims all liability for real-world interactions between users.
9. Intellectual Property Rights
The Winkora name, logo, original UI illustrations (including The Nest artwork, templates for Color Together, UI vector assets, and brand design systems) are the exclusive intellectual property of Winkora. You may not reproduce, reverse engineer, extract, or commercially exploit any proprietary assets without our express prior written permission.
10. Disclaimer of Warranties ("AS-IS")
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that background push alerts will be instantaneously received under all cellular or network environments.
11. Limitation of Liability
IN NO EVENT SHALL WINKORA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, LOSS OF MEMORIES, OR EMOTIONAL DISTRESS ARISING BETWEEN USERS) RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN JURISDICTIONS WHERE LIMITATIONS OF LIABILITY ARE RESTRICTED, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE TOTAL AMOUNT PAID BY YOU TO WINKORA IN THE PRECEDING TWELVE (12) MONTHS.
12. Termination & Account Deletion (Apple Guideline 5.1.1(v) Notice)
Important Subscription Cancellation Notice
Deleting your Winkora account permanently wipes your shared couple records, photos, and messages. However, deleting your account does NOT automatically cancel active Apple App Store subscriptions. You must manually cancel auto-renewing subscriptions inside your iOS Apple ID settings.
You may delete your account at any time via Us → Account Security → Delete Account. Winkora reserves the right to suspend or terminate accounts that breach these Terms or compromise platform infrastructure.
13. Legal Compliance & US Export Sanctions
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
14. Governing Law, Dispute Resolution & Contact
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising hereunder shall be resolved through confidential, binding individual arbitration or small claims courts.
